FILING A PERSONAL INJURY LAWSUIT IN COLORADO
Personal injury victims must prove the following three elements to win their case:Â
- Standard of care:Â This means the other party was obligated to act according to a certain standard to ensure your well-being. For example, a motor vehicle driver is obligated to pay attention to the road and drive with care.
- Negligent violation of that standard:Â Whether intentional or unintentional, if the other party violates the standard of care, they will be considered negligent. Again, for a motor vehicle driver, this may mean driving under the influence of alcohol or texting and driving.
- Injury and damages sustained: This last element requires you to prove that your injuries and damages were a direct result of the other party’s negligence. For instance, if a drunk driver struck you while riding a bicycle, you would need to show that they were drunk at the time, that you were following bicycle laws, and that you had to go to the doctor for your injuries.

HOW LONG DO I HAVE TO FILE A PERSONAL INJURY CLAIM IN COLORADO?
How long injury victims have to file a claim is dictated by a law called the statute of limitations. According to the Colorado Revised Statutes section 13-80-102(1)(a), the statute of limitations for personal injury cases in the state of Colorado for car accidents is three years and two years for other personal injury claims.
More specifically, this means you have two or three years from the date your injury occurred to file your claim, or you will lose your right to file and your right to pursue compensation for your injuries. It’s important to note that there are exceptions that can change this time limit. The most notable exceptions include:
- If the injury victim was a minor at the time of the accident
- If the alleged negligent party leave the state before a lawsuit can be filed
