Filing a Personal Injury Lawsuit in Colorado

Personal injury victims must prove the following three elements to win their case:

For instance, if a drunk driver struck you while riding a bicycle, you would need to show that they were drunk at the time, that you were following bicycle laws, and that you had to go to the doctor for your injuries.

How Long Do I Have to File a Personal Injury Claim in Colorado?

How long injury victims have to file a claim is dictated by a law called the statute of limitations. According to the Colorado Revised Statutes section 13-80-102(1)(a), the statute of limitations for personal injury cases in the state of Colorado for car accidents is three years and two years for other personal injury claims. 

More specifically, this means you have two or three years from the date your injury occurred to file your claim, or you will lose your right to file and your right to pursue compensation for your injuries. It’s important to note that there are exceptions that can change this time limit. The most notable exceptions include:

  • If the injury victim was a minor at the time of the accident 
  • If the alleged negligent party leave the state before a lawsuit can be filed
