Wrongful Death

Denver Wrongful Death Attorneys

We’re Here for You When Tragedy Strikes

There is a common saying about grief—it never truly fades; time just passes. If you have lost a loved one to another’s negligence, we would like to be one of the first to send you condolences.

We know firsthand how losing a loved one can devastate all corners of your life. That’s why we are committed to providing compassionate representation to those bereaved by negligence. You deserve justice for what happened. And although it is likely the last thing on your mind, you also deserve the chance to protect your financial future. A wrongful death lawsuit may accomplish both.

How Our Compassionate Lawyers Can Help

Klenofsky & Steward, LLC fights to win justice for bereaved families. We understand wholeheartedly that nothing can make up for your loss. Still, we have seen how much a civil lawsuit can increase a client’s chance of moving forward.

For many, just knowing the at-fault party was made to answer for their actions helps them to better cope with their loss. The financial compensation that comes with a successful claim can also help you make up for the economic damages of your loss. You may also be compensated for non-economic damages, like pain and suffering.

We will work hard to ensure your claim is in line with your loved one’s wishes. For decades, our experienced wrongful death attorneys have helped numerous clients recover for the losses suffered by the wrongful death of a loved one.

Who Can Recover Compensation for a Wrongful Death?

The state of Colorado grants only certain individuals the right to pursue justice for a wrongful death. The decedent’s surviving spouse is given first priority in the first year after the death. If the surviving spouse chooses, they may task their children (as long as they are also the children of the decedent) to file suit with or without them. After the first year, a beneficiary of the decedent may also file suit with any surviving children.

In the event that the decedent did not have a spouse, children, or beneficiaries, the right to file suit would go to the decedent’s parents.

Is There a Deadline for Filing a Wrongful Death Lawsuit?

All states have deadlines, or “statutes of limitations,” for the filing of a wrongful death lawsuit. In Colorado, this statute of limitations is two years from the date of the death. Under certain circumstances, the deadline may be pushed to four years from the date of the death, if the driver that caused the death committed the crimes of vehicular homicide and leaving the scene of the accident.

How Is Compensation Calculated in a Wrongful Death Case?

Compensation will be calculated by looking at the damages suffered by the decedent and the plaintiff (the person filing suit). As noted, a plaintiff can recover compensation for both economic damages and non-economic damages, such as:

  • Funeral/burial expenses
  • Lost wages
  • Lost financial support
  • Lost benefits
  • Medical expenses
  • Pain and suffering
  • Loss of consortium

The losses resulting from a person’s wrongful death are often extensive. The list above includes only the most common losses for which our clients have sought compensation.
